Unless you have unlimited funds, retaining a law firm in advance for a lengthy legal matter or case in litigation may not always be realistic.

To make it more feasible, your attorney may agree to take on a case, in part, step by step, in accordance with your budget. In many cases this can be accomplished.

Here is one scenario: You need to file a lawsuit to obtain relief in, for example, a real property dispute. Because you are not sure where the case will ultimately go and whether it may settle quickly or take longer, You don't want your funds invested that far at this point in the game. However you do need professional legal assistance getting the case through the courts.

You may first obtain a consultation about your best course of action. The first stage is usually making a proper legal demand prior to filing suit. You pay a flat fee for the consultation, and a flat fee for a demand letter done in proper form to protect your legal rights.

Next step: if the demand does not produce settlement, you may propose to hire the firm to prepare the complaint and summons, and service documents. You pay one flat fee up front for the consultation and preparation of documents.

If the case later becomes litigated, you may opt to have the attorney firm advise as to your next step. If the case is not contested, you may have the attorney firm prepare the legal default documents.

At each stage you pay a fee agreed upon for the services. These legal services are separate retained matters. This will enable you to make payments in a predictable manner, and be assured that you will receive services and make payments only for that particular stage in the matter.

This can work in your budget and allow you to have full representation, although step by step throughout the process.
